Client\u2019s Responsibility<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f475d5b elementor-widget elementor-widget-text-editor\" data-id=\"f475d5b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The Client declares and guarantees:<\/p><p>Be the legitimate owner of the products or be authorized for their distribution.<\/p><p>That the products comply with the applicable regulations regarding:<\/p><ul><li>Health regulations<\/li><li>Cosmetic regulations<\/li><li>Food regulations<\/li><li>Customs regulations<\/li><li>Environmental regulations<\/li><li>Commercial or safety regulations, as applicable.<\/li><li>That the documentation and information provided to Rakk is truthful, complete, and up to date.<\/li><li>That they are responsible for the taxes, fees, permits, and registrations required for the commercialization of their products in the markets where they operate.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2a8b6fd elementor-widget elementor-widget-text-editor\" data-id=\"2a8b6fd\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Rakk shall not be held liable for penalties, costs, or administrative measures resulting from the Client\u2019s regulatory non-compliance.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-490d01e elementor-widget elementor-widget-heading\" data-id=\"490d01e\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">3. Receipt and Storage of Goods<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9f38c19 elementor-widget elementor-widget-text-editor\" data-id=\"9f38c19\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The Client must provide advance notice of shipments. Rakk may reject or hold goods if:<\/p><ul><li>There is no clear identification data.<\/li><li>The content is dangerous, illegal, or infringes third-party rights.<\/li><li>The documentation is incomplete or irregular.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9eaec84 elementor-widget elementor-widget-text-editor\" data-id=\"9eaec84\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Products will be stored in suitable facilities, but custody does not imply Rakk\u2019s responsibility for the ownership, legality, or destination of the product.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a6518f1 elementor-widget elementor-widget-heading\" data-id=\"a6518f1\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">4. Shipping times are subject to:<\/p><ul><li>Carrier availability.<\/li><li>Operating hours.<\/li><li>Logistical and customs conditions.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4bd61cf elementor-widget elementor-widget-text-editor\" data-id=\"4bd61cf\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Rakk does not guarantee final delivery times, as the transportation phase is carried out by external companies selected by the Client or by Rakk on their behalf.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a066b7c elementor-widget elementor-widget-heading\" data-id=\"a066b7c\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">5. Delegated Responsibility Services (\u201cResponsible Person\u201d)\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2c1b409 elementor-widget elementor-widget-text-editor\" data-id=\"2c1b409\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>(Only if the Client expressly contracts this service) In the event that Rakk acts as the Responsible Person before European authorities under Regulation (EC) 1223\/2009 or other applicable regulations:<\/p><ul><li>A specific agreement, in addition to these Terms and Conditions, will be formalized.<\/li><li>Rakk will assume functions of document supervision, regulatory compliance verification, and record maintenance.<\/li><li>This service will incur an additional cost and ongoing obligations.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a49e6d7 elementor-widget elementor-widget-text-editor\" data-id=\"a49e6d7\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Without such an agreement, Rakk does not act as the legal responsible party for the product before health, regulatory, or customs authorities.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1ea17eb elementor-widget elementor-widget-heading\" data-id=\"1ea17eb\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">7. Liability and Disclaimers\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-860e8a0 elementor-widget elementor-widget-text-editor\" data-id=\"860e8a0\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Rakk shall not be liable for:<\/p><ul><li>Incidents arising from external transportation.<\/li><li>Loss of profits, consequential damages, or indirect damages.<\/li><li>Damages or blockages caused by the Client\u2019s regulatory non-compliance.<\/li><li>Stock discrepancies arising from undeclared or inaccurate inventories.<\/li><li>Content, composition, or effects of the product.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-357348a elementor-widget elementor-widget-text-editor\" data-id=\"357348a\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Rakk\u2019s maximum liability to the Client shall, in no case, exceed the value of three (3) months of services billed immediately prior to the incident.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5786b5c elementor-widget elementor-widget-heading\" data-id=\"5786b5c\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">8. Billing and Payments<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-37b1368 elementor-widget elementor-widget-text-editor\" data-id=\"37b1368\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Rates will be agreed upon in writing with the Client.<\/p><p>Services will be invoiced monthly, unless otherwise agreed.<\/p><p>In the event of non-payment or delay, Rakk may:<\/p><ul><li>Temporarily suspend the services.<\/li><li>Hold goods until the outstanding balance is settled.<\/li><li>Apply surcharges or interest as provided by law.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-757a4d1 elementor-widget elementor-widget-heading\" data-id=\"757a4d1\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">9.
